Tape In Core Terms — Russian Legal Profile

Revision RU-004. English translation of the Russian legal profile.

1. Operator

Tape In services are provided by sole proprietor Andrey Viktorovich Shabaev-Markin (ИП Андрей Викторович Шабаев-Маркин), INN 027815065929, OGRNIP 314774605600902. Legal matters: legal@tapein.ru. Personal data: privacy@tapein.ru. Support: support@tapein.ru.

2. Tape In ecosystem and scope

Tape In is an ecosystem of services with one common legal framework. These Terms govern the creation and use of the unified Tape In account and the general rules for Tape In services. The current published Russian product model includes Tape In Setlist, Tape In Studio and Metronome.

A product-specific addendum or notice may apply where a product’s functions, User Content, storage, sharing or other characteristics require additional rules. A product module applies only to that product. Adding a new service does not retroactively expand permissions previously given by the User: before a new processing activity or materially different contractual term is launched, Tape In updates the relevant document and obtains separate confirmation where required.

3. Age and legal capacity

Tape In account registration is intended for persons aged 18 or older who have the required legal capacity. Services that do not require an account may be used without registration unless a particular product states otherwise.

4. Formation of the contract

The User accepts these Terms by an explicit action at registration, such as selecting an unchecked “I accept the Terms of Use” box and creating an account, or by an equally clear action. Before acceptance, the exact revision is linked to the User. Tape In records the Terms version or identifier and the time of acceptance. The Personal Data Processing Policy and separate consents are not bundled with acceptance of these Terms.

5. Account

The User provides an email address available to them and must take reasonable measures to protect access credentials. Tape In may use email verification, session management, request-rate limits and other proportionate security measures. One account may provide access to multiple Tape In products according to the User’s available rights.

6. Free mode

The current launch is free. These Terms do not create a paid subscription, automatic renewal or an obligation to provide a payment method. Separate commercial terms will be published before paid functions are launched.

7. User Content

Rights in setlists, text, notes, projects, audio recordings, titles, files and other User materials do not transfer to Tape In merely because the services are used. The User grants Tape In only the limited non-exclusive technical permission needed for the selected function: receiving and storing data, technical reproduction and transformation, synchronization, preview and export, delivery to a recipient selected by the User when a sharing function is invoked, operation of actual backup/recovery mechanisms and deletion under the applicable lifecycle.

The User is responsible for having the necessary rights and lawful grounds for materials they enter, upload, import or disclose, including third-party rights and third-party personal data.

8. Public access by link

If the User creates a public-link publication in Tape In Setlist, the selected material may be accessible to anyone who obtains the link. The link is not confidential storage. Revocation stops future delivery through Tape In but cannot remove copies already saved by third parties outside Tape In.

9. Acceptable use

Tape In must not be used to violate law or third-party rights, obtain unauthorized access, interfere with security or availability, knowingly distribute unlawful material, or bypass technical security controls.

10. Tape In intellectual property

Rights in Tape In software, interface, branding and documentation remain with their respective rightsholders. The User receives a limited right to use available functions in accordance with these Terms.

11. Personal data

Personal-data processing is described in a separate Policy. Where processing is objectively necessary to perform the contract and the law permits that basis, Tape In does not replace it with blanket consent. Marketing and other specific consents are collected separately where necessary.

12. Availability and backup

Tape In does not promise uninterrupted or error-free operation. Tape In describes only backup and recovery mechanisms that are actually in use. For critical material, Users should keep an independent exported copy where the product provides an export function.

13. Restriction of access

Tape In may proportionately restrict a function, public link, session or account where necessary because of a material security risk, serious breach of law or these Terms, a binding order of a competent authority or the need to prevent material harm. Mandatory User rights that cannot be waived remain unaffected.

14. Liability

The parties are liable within the limits of applicable law. These Terms do not exclude mandatory consumer rights or other guarantees that cannot lawfully be excluded by agreement.

15. Document changes and new services

Each revision of the Core Terms and each product module has its own version and date. Previous revisions are archived. A new service is added to the common Tape In legal framework and, where necessary, through a product module. Re-acceptance is requested only for a material contractual change or where required by law.

16. Governing law and disputes

These Terms and the contractual relationship arising from them are governed by the substantive law of the Russian Federation. To the extent permitted by mandatory law, disputes are resolved by competent courts of the Russian Federation. This clause does not limit mandatory consumer rights, including non-waivable territorial jurisdiction rights.
