Global Terms of Service
1. Who We Are
Tape In is operated by sole proprietor Andrey Viktorovich Shabaev-Markin (ИП Андрей Викторович Шабаев-Маркин), OGRNIP 314774605600902, INN 027815065929, registered on 25 February 2014 by Interdistrict Inspectorate of the Federal Tax Service No. 46 for Moscow, Russian Federation.

Privacy contact: privacy@tapein.ru

2. Scope And Eligibility
Tape In uses a separate Russian legal launch path and a separate international legal path.
Officially supported international launch markets at this stage: United States, Australia and New Zealand.
EU/EEA, the United Kingdom, Canada and all other countries are not supported registration regions in this release. Account creation is unavailable for those regions unless a later country decision and legal-routing release explicitly enables them. Tape In must not describe or market those regions as supported launch markets.
The supported-country list is enforced by the registration legal-routing policy. Selecting “Other countries” informs the user that registration is unavailable; it does not switch the account to another legal profile.
International account registration is 18+.
Current launch mode is free. Paid subscriptions, auto-renewal, refund, tax/payment and consumer-billing terms are a separate future gate.
3. Acceptance And Account Evidence
You enter into these Terms by an explicit affirmative action at registration, such as checking an unchecked “I agree to the Terms of Service” box and creating an account.
Tape In may keep evidence necessary to prove the transaction and route the applicable legal version, including an internal account identifier, the Terms version or hash, the acceptance time in UTC, interface locale, signup surface/build and the Privacy Notice version presented. Optional consent records, if any, are kept separately from Terms acceptance.
4. Account Security
You must provide accurate account information that is reasonably necessary for the service and keep your credentials confidential. You must not share access in a way that defeats account security or workspace isolation.
If you believe your account has been compromised, contact support@tapein.ru. Tape In may take proportionate security measures, including session revocation or temporary suspension, where reasonably necessary to protect the account, other users or the service.
5. Free Service And Availability
The current free launch is provided without a subscription charge. No payment method is required under this free launch. Tape In will not convert the free service into a paid subscription or recurring charge without a separate clear offer and the user’s affirmative agreement to the applicable paid terms.
The service may contain defects, incomplete functionality or changing features. Tape In will use reasonable care in operating the service but does not promise uninterrupted availability, error-free operation or preservation of every feature indefinitely.
Nothing in this section excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law where it applies.
6. User Content And The Unified Account
The Global Terms govern the unified Tape In account. A user registers once and uses one identity across enabled Tape In products. Product-specific terms apply only where a product or function objectively needs additional rules and are accepted once at first use of that product/function, with re-acceptance only for material changes or where law requires it.
User Content remains private by default. Rights in User Content do not transfer to Tape In merely because content is entered, uploaded, synchronized or stored. The user grants only the limited non-exclusive technical permission needed to provide the requested service: store, reproduce technically, format, generate previews/exports, transmit to an intended recipient where the user invokes a sharing function, maintain real backup/recovery functions, and perform security/support operations.
Tape In does not receive a general license to sell private User Content, advertise with it, or use it for general-purpose model training merely because the user accepts the Terms.
Users must have the rights and permissions necessary for materials they upload/share, including copyright, performer/recording rights, third-party personal data and confidential information where relevant.
7. Setlist / Sharing Addendum
Private Share and Public Share are separate functions.
Private Share is recipient-specific, reusable across Tape In products, revocable by the owner and may work for a recipient who does not yet have a Tape In account. If the recipient later registers, access should map into the unified Tape In identity model rather than create a product-local identity.
Public Share is a separate explicit disclosure mode. A public/bearer link must not include account email, auth/session identifiers, internal user/workspace IDs or unrelated service metadata. Revocation stops future delivery through Tape In but cannot retrieve copies already made by recipients outside Tape In.
8. Acceptable Use
Users must not use Tape In to violate law or third-party rights, obtain unauthorized access, attack or disrupt the service, distribute malware, impersonate others in a harmful manner, publish content unlawfully, evade technical restrictions or use another person's account without authorization.
Good-faith security research performed within the published Responsible Disclosure rules is not prohibited solely because it identifies a vulnerability.
9. Tape In Intellectual Property
Tape In and its licensors retain rights in the service software, interface, branding, documentation and other materials supplied by Tape In, excluding User Content and third-party materials.
These Terms give you a limited, personal and non-exclusive right to use the service as offered during the free launch. That right may be suspended or terminated only as provided in these Terms and applicable law. They do not transfer ownership of Tape In software or branding to you.
10. Privacy And Optional Marketing
Tape In’s processing of personal information is described in the Global Privacy Notice.
Core account/service processing is not based on blanket consent to the Privacy Notice. The Notice is presented at or before collection; the applicable legal basis is mapped by purpose. Optional consent is used only where consent is actually required or intentionally chosen, including marketing and optional analytics/storage where applicable.
Marketing is optional and separate from Terms, Privacy Notice and transactional mail.
The marketing checkbox must be unchecked by default and refusal must not block core service access.
Evidence must store exact consent text/version, timestamp, user/account ID, surface/build/locale and withdrawal/unsubscribe state. Withdrawal stops future marketing but does not disable verification, security, password-reset or other transactional service messages.
11. Changes To The Service
Tape In may improve, replace or discontinue service features where reasonably necessary for product development, security, legal compliance or operational reasons. Where a material change is likely to significantly reduce an existing user-facing function, Tape In will provide reasonable notice when practicable unless urgent security or legal action makes advance notice impracticable.
Tape In will not use this clause to impose a paid subscription, recurring charge or materially different legal bargain without the user’s separate affirmative agreement where required.
12. Suspension And Termination
You may stop using Tape In at any time. Account deletion/export mechanisms and the current operational request route are described in the Privacy Notice and product documentation as they become available.
Tape In may suspend or terminate access where reasonably necessary because of a serious or repeated breach of these Terms, unlawful use, a material security risk, abuse affecting other users, or a legal requirement. Where practicable, Tape In will give notice and a reasonable opportunity to address a remediable issue before permanent termination. Immediate action may be taken where delay would create material security, legal or safety risk.
A termination does not remove rights or obligations that by their nature survive termination, including accrued legal claims, intellectual-property protections and lawful retention obligations.
13. Service Disclaimers And Mandatory Rights
Tape In is a developing service. To the extent permitted by law, features may be experimental and may change. You should maintain independent copies of material that is important to you where the product permits export or download.
Nothing in these Terms excludes, restricts or modifies any statutory guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified. In particular, where the Australian Consumer Law applies, these Terms are subject to the consumer guarantees and remedies that the law makes non-excludable.
No wording such as “beta”, “as is”, “no warranty” or similar language is intended to override a mandatory consumer right.
14. Responsibility And Liability
Each party remains responsible for loss caused by its own fraud, wilful misconduct or other liability that applicable law does not permit to be excluded or limited.
To the extent permitted by applicable law, Tape In is not responsible for loss caused solely by the user’s unlawful use, unauthorized disclosure of credentials, or modification of exported material outside Tape In’s control, nor for events outside Tape In’s reasonable control where reasonable mitigation was not possible.
Any limitation in these Terms must be interpreted narrowly so that it does not remove a mandatory consumer remedy or create a significant unfair imbalance in a standard-form consumer contract.
15. Service Providers
Current production controller and primary storage/processing geography for the launch scope: Russian Federation, Selectel infrastructure. Current launch-scope transactional/verification email path is Russian.
A third-party service may have its own technical availability or legal terms, but a provider’s terms do not replace these Terms between you and Tape In.
16. Governing Law And Dispute Resolution
These Terms and the contractual relationship arising from them are governed by the substantive laws of the Russian Federation.
To the extent permitted by mandatory applicable law, any dispute arising out of or relating to these Terms shall be submitted to the competent courts of the Russian Federation.
This section does not constitute a voluntary choice of the law of any other jurisdiction. It does not limit any consumer protection or statutory venue right that cannot lawfully be excluded or restricted by agreement.
Before litigation, either party may contact the other and attempt to resolve the issue in good faith. This does not limit urgent remedies or statutory complaint rights.
17. Changes To These Terms
Tape In may update these Terms for product, legal or security reasons. The updated version will have a new version/date identifier.
If a change materially alters the contractual bargain or is materially adverse to existing users, Tape In will normally provide at least 30 days’ advance notice before the change takes effect. A shorter period may be used where reasonably necessary to address an urgent security issue, legal requirement, fraud/abuse risk or another circumstance in which waiting would create material harm or non-compliance. Tape In will obtain renewed affirmative acceptance where required by law or where the change should not fairly be imposed on existing users without agreement. Changes do not operate retroactively to remove accrued rights.
18. Regional Provisions
US REGIONAL MODULE
Tape In may officially support the United States under the free 18+ launch profile, subject to a maintained state-law applicability matrix based on real scale and activity. No sale of personal information, no targeted advertising and no third-party behavioral advertising is authorized by this launch package. A neutral 18+ gate is used; full date of birth is not collected solely to prove acceptance unless a later legal requirement establishes the need. State-specific rights must be enabled only where applicable and must not be falsely claimed where thresholds/scope are not met.
AUSTRALIA REGIONAL MODULE
Tape In may officially support Australia under the free 18+ launch profile. The Australian privacy applicability position must be kept current against actual turnover and statutory small-business exceptions. The service must preserve mandatory Australian Consumer Law rights. If the Privacy Act applies, APP transparency, access/correction, security, complaints, NDB and overseas-disclosure handling must be implemented. Russian controller/storage geography must be disclosed.
NEW ZEALAND REGIONAL MODULE
Tape In may officially support New Zealand under the free 18+ launch profile. Privacy contact/accountability, access/correction, complaints, serious privacy breach handling and overseas-disclosure classification must be operational. Russian controller/storage geography and actual service providers must be disclosed.
EU/EEA UNSUPPORTED REGISTRATION MODULE
EU/EEA is not a supported registration region in this release. Tape In does not offer account creation for EU/EEA through the current launch flow. A later launch requires a separate legal and technical activation decision.
UK UNSUPPORTED REGISTRATION MODULE
The United Kingdom is not a supported registration region in this release. Tape In does not offer account creation for the UK through the current launch flow. A later launch requires a separate legal and technical activation decision.
19. Contact
Legal: legal@tapein.ru
Privacy: privacy@tapein.ru
Support: support@tapein.ru
20. Feedback
If you voluntarily send Tape In suggestions, bug reports, feature requests or other material specifically as product feedback, Tape In may use that feedback to evaluate, improve and develop its services without payment or a duty to keep the feedback confidential, unless Tape In expressly agrees otherwise in writing. This feedback rule does not transfer ownership of, or authorize unrelated use of, your songs, recordings, lyrics, projects or other User Content merely because you discuss them while giving feedback. Do not include third-party confidential information in feedback unless you are authorized to disclose it.
21. General Legal Terms
If any provision of these Terms is found unenforceable, the remaining provisions continue to apply to the extent permitted by law, and the affected provision should be interpreted or limited as closely as lawful to its intended purpose. A delay or failure to enforce a right is not a waiver of that right.
Provisions that by their nature are intended to survive termination — including accrued rights and claims, intellectual-property protections, lawful retention obligations, responsibility for prior conduct and applicable dispute provisions — survive to the extent legally appropriate.
These Terms, together with any product-specific terms expressly incorporated for a feature and the mandatory law that cannot be displaced, form the applicable agreement for the service. If a product-specific term conflicts with these general Terms, the more specific term governs that product issue; mandatory law always prevails. A Privacy Notice describes information handling and does not silently replace or amend these Terms.
Formal notices from Tape In concerning these Terms may be delivered through the service, to the account email address, or through another contact method reasonably connected with the account. Users may send legal notices to legal@tapein.ru. This does not restrict any statutory method of service or regulator/tribunal contact that cannot lawfully be excluded.
Tape In may transfer these Terms only as part of a genuine transfer or reorganization of the Tape In business or relevant service, or to a lawful successor, and only subject to applicable law. Such a transfer must not be used to remove mandatory user rights. Where a transfer materially affects users, Tape In will provide reasonable notice where practicable and legally required.
